Terms of Service

These Terms of Service apply to photography services, photography coaching, workshops, e-books and other digital products provided by Sarah Hoornaert Photography (“I”, “me”, “my”, or “Sarah Hoornaert Photography”).

By booking a photography session, purchasing a coaching service, e-book or other digital product, you confirm that you have read, understood and agreed to these Terms.

These Terms apply to services provided in the United Arab Emirates and are governed by applicable UAE law.

1. Booking & Payment

A photography session is considered booked only once full payment has been received.

Full payment is required to secure your date and time. I accept payment by bank transfer, payment link or cash where available.

Your payment confirms that you have accepted these Terms of Service.

Because your booking reserves a specific date and time exclusively for you, payments are generally non-refundable, subject to the cancellation, rescheduling and refund provisions set out below and any rights you may have under applicable UAE law.

2. Cancellation & Rescheduling

If you need to cancel your photography session, please contact me as soon as possible.

Cancellation within one week of the session

If you cancel within the week before your scheduled session, the amount paid is normally forfeited.

Where you have a valid reason for cancellation, I may offer you a voucher equal to the amount originally paid instead of forfeiting the payment.

A voucher is valid for a maximum of 12 months from the date it is issued.

You may also request another available date instead of cancelling your booking. Rescheduling does not incur a rescheduling fee.

A voucher cannot be exchanged for cash or a refund.

If you choose a future session that costs more than the value of your voucher, you must pay the difference.

The package originally purchased remains the package booked. A client cannot change or downgrade their package after the session has taken place, and the unused portion of a package is not refundable.

3. Cancellation by Sarah Hoornaert Photography

I reserve the right to cancel or postpone a session where circumstances make the session unsafe, impractical or impossible to carry out.

This may include, but is not limited to, severe weather, unsafe environmental conditions, location restrictions, illness, emergencies or circumstances outside my reasonable control.

Where I cancel a session and a suitable alternative date cannot be arranged, I may provide a refund of the amount paid.

Where appropriate, I may instead offer an alternative date or voucher by agreement with the client.

4. Weather & Environmental Conditions

Photography involving animals is often affected by weather and environmental conditions.

Where weather conditions make a session unsuitable or unsafe, the session may be postponed.

The decision to postpone a session for safety or photographic reasons will be made by Sarah Hoornaert Photography.

Weather-related postponements will normally be rescheduled without an additional rescheduling fee.

5. Animals & Safety

The safety of the client, animals, photographer and anyone present during a session is a priority.

The animal's owner or handler is responsible for the animal throughout the session.

You must inform me before the session of any known:

Aggressive behaviour
Dangerous behaviour
Biting, kicking or charging behaviour
Fear or anxiety
Previous incidents involving people or other animals
Medical or behavioural conditions that may affect the session

You are responsible for your animal's behaviour and for following reasonable safety instructions during the session.

I reserve the right to stop, postpone or refuse to continue a session if I believe that an animal, person, location or situation presents an unreasonable safety risk.

This may happen without warning where immediate safety is a concern.

Where a session is stopped because of a safety issue caused by the client or their animal, no refund is guaranteed.

Where I stop a session for another reason, I may offer a refund, rescheduling or another appropriate solution depending on the circumstances.

6. Location Permissions

If you request a specific photography location, you are responsible for obtaining any required permission and paying any location, access, permit or entry fees unless we have agreed otherwise in writing.

If permission is refused, withdrawn or unavailable, you are responsible for arranging another suitable location.

A location problem outside my control does not automatically entitle you to a refund.

The replacement location must be reasonably suitable and safe for the photography session.

7. Travel Fees

Travel fees may apply depending on the location of your photography session.

Any applicable travel fee will be communicated before booking.

Travel fees may include reasonable travel-related costs associated with reaching the agreed location.

If a session is cancelled because you arrive too late, any applicable travel fee remains payable.

8. Client Lateness

Please arrive on time.

If you are up to 20 minutes late, I may still proceed with the session, but the available photography time may be reduced.

If you are more than 20 minutes late, the session will be considered cancelled and no refund will be provided.

You may request to rebook the session, subject to availability. A new travel fee will apply where applicable.

9. Photography Packages & Image Selection

The number of photographs included in your session is determined by the package you selected at the time of booking.

The package cannot be changed, upgraded, downgraded or partially refunded after the photography session has taken place.

After your session, you will receive a proofing gallery from which you can select the images included in your package.

You have one month to make your selection.

If you do not make your selection within this period, delivery may be delayed.

10. Additional Images

Additional photographs may be purchased separately from your selected package.

Additional images can be selected through the gallery and must be paid for before they are edited and delivered.

Additional images will be edited according to my normal editing style.

The price of additional photographs is based on my current pricing at the time of purchase.

11. Image Delivery & Gallery

Final photographs are delivered digitally according to the package purchased and any additional photographs purchased.

Your online gallery will remain available for approximately one month.

You are responsible for downloading and safely storing your photographs.

You have a maximum of 7 days to download your photographs after they have been delivered.

I may retain backups of photographs for a limited period, but I do not guarantee permanent storage of your files.

If your gallery needs to be reopened after delivery, I may reopen it once.

I may also re-upload the edited photographs once if necessary.

Further requests to reopen the gallery or re-upload photographs may be subject to an additional fee.

12. Editing & Artistic Style

Editing is an essential part of my photography style.

By booking with me, you acknowledge that you are hiring me based on my portfolio and artistic approach.

The final photographs will be edited according to my creative style.

I do not provide RAW files, unedited photographs or unfinished images.

RAW files remain part of my working files and are not included in photography packages.

I do not guarantee that your photographs will look exactly like photographs you have previously seen on my website, Instagram or other platforms. Every animal, person, location, lighting condition and session is different.

You may request reasonable editing corrections within 7 days of receiving your final photographs.

Editing requests do not include requests to completely change my artistic style or recreate another photographer's editing style.

13. Client Alterations

You may crop photographs for normal social-media use provided that my logo/credit remains visible.

If you need to crop an image in a way that removes the logo, please contact me. Where appropriate, I can provide an alternative version or advise you on the correct way to use the photograph.

You may not apply filters, presets or other edits that substantially alter the photographs.

This includes, but is not limited to:

Changing colours
Applying heavy filters
Changing the overall editing style
Removing objects
Adding objects
AI manipulation
Substantially altering the composition
Removing my logo or identifying marks

Any authorised modification or alternative version must be agreed with me beforehand.

14. Copyright

All photographs created by Sarah Hoornaert Photography remain my intellectual property and are protected by applicable copyright law.

The purchase of photographs does not transfer copyright ownership to the client.

You receive a limited personal-use licence to use the photographs you have purchased.

This means you may use your photographs for personal purposes, including sharing them on your personal social-media accounts and making personal prints.

You may not sell, license, transfer or commercially exploit the photographs without my prior written permission.

This includes giving the photographs to a business, stable, brand, trainer or other commercial organisation for use in advertising, marketing or promotional materials.

15. Commercial Use

Photography purchased for personal use does not include commercial usage rights.

Commercial use includes, but is not limited to:

Advertising
Business websites
Brand marketing
Social-media marketing for a business
Promotional campaigns
Paid advertising
Business publications
Marketing materials
Sponsorship or promotional use

If you or another organisation would like to use an image commercially, please contact me.

A separate commercial licence and fee may apply.

Commercial use is not permitted until the relevant licence has been agreed and paid for.

16. Competitions, Publications & Third-Party Use

Your personal-use licence does not automatically include permission to:

Submit photographs to publications
Submit photographs to commercial websites
Enter photographs into competitions
License photographs to another person or organisation
Give photographs to businesses or brands
Use photographs for commercial promotion

Please contact me before submitting or licensing photographs for these purposes.

17. Photographer Credit

When sharing photographs publicly, you are required to credit Sarah Hoornaert Photography.

Where social-media tagging is available, please tag the relevant Sarah Hoornaert Photography account.

Removing or deliberately hiding the photographer credit is not permitted.

18. Portfolio & Promotional Use

By booking a photography session, you automatically give Sarah Hoornaert Photography permission to use photographs from your session for portfolio, website, social-media and promotional purposes, including:

Instagram
Facebook
Website
Behind-the-scenes content
Photography portfolio
Promotional materials

If you do not want your photographs used for these purposes, you must inform me before the photography session.

If you have concerns about a particular photograph being used publicly, please discuss this with me before the session where possible.

19. Other People in the Frame

My photography sessions are intended to focus on the client, their animal and the agreed subjects.

Where another person unintentionally appears in the background of an image, I may remove or exclude that person during editing where reasonably possible.

The presence of another person in the background does not automatically constitute grounds for a refund or reshoot.

20. Equipment & Behaviour

I reserve the right to immediately stop a session where a client or anyone accompanying them behaves aggressively, abusively, threateningly or in a manner that puts me, my equipment, an animal or another person at risk.

This includes threats to damage or intentionally damaging photography equipment.

Where a session is terminated because of inappropriate, abusive, threatening or dangerous behaviour by the client or someone accompanying them, the client will not be entitled to a refund, to the extent permitted by applicable UAE law.

I may also refuse future bookings where I reasonably believe that continuing the professional relationship would create a safety or security concern.

21. Liability & Personal Responsibility

You participate in photography sessions at your own responsibility.

To the extent permitted by applicable UAE law, Sarah Hoornaert Photography is not responsible for loss, injury or damage arising from circumstances outside my reasonable control, including:

Injuries caused by an animal
Injuries caused to an animal
Human injuries caused by an animal
Damage caused by an animal
Loss or damage to personal belongings
Weather or environmental conditions
Problems caused by a venue or location
Failure by the client or animal handler to follow safety instructions

You remain responsible for supervising your animal and personal belongings throughout the session.

Nothing in these Terms is intended to exclude or limit any liability or consumer right that cannot legally be excluded or limited under applicable UAE law.

22. Photography Results & Expectations

I will always work to create photographs consistent with my portfolio and established artistic style.

However, photography is influenced by factors outside my control, including:

Animal behaviour
Weather
Lighting
Location
Movement
Cooperation
Timing
Client expectations
Environmental conditions

Because of this, I cannot guarantee a particular pose, expression, action photograph, lighting condition or specific image.

A client's dissatisfaction with the fact that their photographs differ from another session or photograph in my portfolio does not automatically constitute a failure to provide the service.

23. Photography Coaching & Education

These Terms also apply to photography coaching, workshops, e-books and other educational services or digital products provided by Sarah Hoornaert Photography.

Photography coaching and educational services follow the same cancellation and rescheduling policy as photography sessions unless otherwise stated at the time of booking.

Educational materials, including e-books, guides, templates, videos, lessons and other resources, are provided for the purchaser's personal use.

You may not:

Copy the materials
Redistribute them
Share them with others
Resell them
Publish them
Upload them to another platform
Claim them as your own work

All educational materials remain the intellectual property of Sarah Hoornaert Photography.

Coaching and educational services provide guidance and education but do not guarantee a particular photography, business, financial or career outcome.

Coaching sessions may not be recorded, reproduced or distributed without prior written permission.

24. Digital Products

All digital products are non-refundable, subject to any mandatory rights provided by applicable UAE law.

Once a digital product has been purchased or accessed, the purchase cannot normally be cancelled or refunded.

Digital products are licensed to the purchaser for personal use and may not be shared, copied, resold or redistributed.

25. Changes to Packages & Pricing

Sarah Hoornaert Photography may change package prices, services and availability from time to time.

Any price or package agreed and paid for at the time of booking will remain applicable to that booking, unless otherwise agreed.

Changes to future pricing do not affect bookings that have already been confirmed and paid for.

26. Force Majeure

I am not responsible for failure or delay in providing services caused by circumstances beyond my reasonable control.

This may include serious illness, accidents, extreme weather, natural events, government restrictions, venue closures, emergencies, transportation disruptions or other circumstances that could not reasonably have been prevented.

Where reasonably possible, I will work with the client to reschedule the service.

27. Governing Law

These Terms of Service are governed by the laws applicable in the United Arab Emirates.

Any dispute arising from or relating to these Terms or services provided by Sarah Hoornaert Photography will be dealt with in accordance with applicable UAE law and the jurisdiction of the competent UAE courts.

Nothing in these Terms removes or limits any mandatory rights available to consumers under applicable UAE law.

28. Acceptance of These Terms

By booking a photography session, purchasing a coaching service, workshop, e-book or other digital product from Sarah Hoornaert Photography, you confirm that you have had the opportunity to read these Terms of Service and agree to be bound by them.
