Terms of Service
1. General
1.1. When booking a photo shoot or ordering photos and products from Sarah Hoornaert Photography you automatically (tacitly) agree to these terms and conditions.
1.2. These conditions and rates can be changed at any time by the photographer.
1.3. If you do not agree or have any objections to these terms and conditions, you must make this clear in writing before the reportage has taken place.
2. Liability
2.1. Under no circumstances can the photographer be held liable for any material or physical damage incurred during the reportage. What breaks during the shoot by the model, will be reimbursed by the model.
2.2. You are responsible for the safety of your belongings and yourself during the shoot. Participation in a reportage is at your own risk.
3. The photo reportage
3.1. You book a reportage with a certain photographer because the style of the photos appeals to you. The photographer is free to apply his/her own artistic knowledge and insight to the reportage.
3.2. At the end of the photo session, the photographer can choose one photo and edit it. The rest you can choose yourself. The waiting time for sending the edited photos can vary. Usually it takes about 8 – 9 weeks, depending on the number of photos. You can order additional photos up to 1 month after the reportage has taken place.
3.3 Photos not chosen by the client may still be edited and used by the photographer.
3.4 Subsequent orders are possible on a separate, password-protected page on the website.
3.5 The viewing photos shown on the follow-up order page are unedited, clearly watermarked and may not be used (in public) under any circumstances.
4. Booking
4.1. Booking is possible via email, Facebook or the website. Telephone or verbal appointments must always be confirmed in writing.
4.2. A photo shoot will take place at a location, which the client and photographer have agreed upon. Any travel expenses of the photographer are not included in the price of a photo shoot.
4.3. After each booking, the client will receive an invoice via email that must be paid before the photo shoot. Only when the full payment is made before the shoot, the photographer can deliver the photos.
4.4. When a session is booked, it cannot be cancelled. It can, however, be rescheduled if agreed in writing with the photographer. This will be decided at the latest on the morning of the planned shoot.
The photographer can decide to reschedule due to weather conditions, in which case we will immediately look for a new date for the shoot. In the winter period often a reserve date will be agreed upon, in case of bad weather the shoot will continue on the reserve date.
4.5. If the client chooses to cancel the order, for whatever reason, 50% of the total amount will be refunded if the cancellation is made more than 7 days before the date of the reportage. If less than 7 days before the shoot, the shoot will not be refunded, only the transportation costs will be refunded. These appointments are often difficult for the photographer to make and are retained for administrative costs and to keep the schedule free, among other things.
4.6. Refund of money is not possible under any circumstances. However, a solution can be sought if you have any complaints.
5. Complaints
5.1. Complaints regarding the work delivered should be made in writing to the Photographer as soon as possible, but in any case within five working days of delivery of the edited photos.
5.2. The Photographer has the right to deliver good work for rejected work within a reasonable period. If these complaints have a valid reason and where mentioned in time, a new photo reportage can be planned to rectify these complaints. For this shoot, you will only have to pay the travel expenses incurred by the photographer, if agreed upon with the photographer.
5.3. Under no circumstances can a service be subject to a refund.
6. Copyrights and publication
6.1. Copyrights (and other rights attributed to the photographer by Belgian law) of all reports remain the property of Sarah Hoornaert Photography. This means that the pictures may not be used (commercially) without permission. The photos may also not be edited, adapted, cropped or modified (e.g. with photoshop) without permission of the photographer. The photographer’s logo must be visible at all times. Photos without a logo are for prints only. These are not to be posted on social media. Want to use a photo as a profile picture or crop it for Instagram? Please ask for PERMISSION for this. If the logo would be omitted it will be adjusted for FREE.
6.2. The photos provided remain copyrighted. You are buying a digital photo or print, not the rights to the photo. If there is no mention of ‘Sarah Hoornaert Photography’ on every form of publication, the photographer can charge an extra fee of at least 100% of the amount due for publication rights.
The copyrights of the photographs remain at all times in the possession of Sarah Hoornaert Photography.
6.3. You must have written proof that you made an agreement with the photographer if you wish to use the photos for commercial purposes.
6.4. Any assigned right to publication is personal and non-transferable.
6.5. Paternity law obliges the user of a photograph to mention the name of the photographer in any use of their images.
6.6. All photographs of Sarah Hoornaert Photography are copyrighted. Therefore, they may not be reproduced or published without the prior written consent of Sarah Hoornaert Photography. Even digital files are copyrighted and therefore solely for your own use and not for publication. If photos are passed from Sarah Hoornaert Photography for publication to another company, news or magazine the client will be informed if it is/will be effectively published.
6.7. When booking a photoshoot the client, gives Sarah Hoornaert Photography the right to use all photos taken for business and commercial purposes such as blog, portfolio, newsletter, social media, personal use, photo competitions, communicate with magazines, events and workshops.
If there is any objection to this, the client must make it clear in writing beforehand. Customers who do not want to have their photos published at all can have this done after consultation and with a small print run to be discussed among themselves.
7. Terms of Payment
7.1. By placing an order you indicate that you agree with these payment terms. These conditions apply to all orders, unless otherwise agreed in writing by both parties.
7.2. You will receive an invoice as soon as possible after placing your order, containing a description of the order, the costs and the bank details to pay the invoice.
7.3. The payment term is 14 days after receipt of the invoice, without deduction of discount cash, unless otherwise agreed.
7.4. In the event of non-payment by the due date, interest will be payable equal to the statutory rate, without prior notice of default. Also, an administration fee of 10% of the price is due.
8. Privacy and personal data
8.1. Sarah Hoornaert Photography is responsible for the processing of personal data as shown in this privacy statement.
8.2. The client’s personal data may not be disclosed by the photographer to third parties.
8.3. If you do not want to disclose names, location or date on social media or other publicity opportunities but the photo may be published, advance notice must be given.

9. Portfolio & Win Reportages
9.1 If a reportage is done for the portfolio of the photographer, no reportage costs will be charged. However, transportation charges may apply.
9.2 In case of a portfolio report, the client will only receive digital web files with logo. The number of photos depends on the agreement made beforehand.
9.3 If a report is won via social media or other possibilities, the conditions for the won report will be mentioned in the article to win the report and will be communicated at the time of contacting the winner. This may vary from win to win action.
9.4 In case of a win, a gift card will be sent or a photo shoot will be planned immediately. If no voucher is sent, the reportage won may expire after 6 months after the winner is announced.
9.5 A portfolio or reportage won can under no circumstances be converted into money or asked for a refund.
9.6 The conditions will always be communicated at the time of the win action, call or contact and are valid in addition to these conditions.
10. Gift Card
10.1 A gift card is always paid for the expense. The buyer of the voucher chooses a package voucher or pays an amount to choice voucher.
10.2 A gift card is valid for 12 months after receipt by the purchaser, the certificate is not renewable. If the voucher is not redeemed before expiration date, there is a possibility that an additional fee can be charged.
10.3 A voucher must always be handed in at the appointment and MUST be mentioned BEFOREhand at the booking.
10.4 A gift card cannot be exchanged for money.
